NewJeans' Hanni reaches settlement with malicious commenter ... Shows mercy despite insulting comment: "Does crying help?"

 

NewJeans Hanni has reached a settlement with a malicious commenter.

On the 27th, the Seoul Southern District Court’s 14th Criminal Division dismissed the public prosecution against 'A,' who was charged with defamation for leaving malicious comments toward NewJeans' Hanni.

Last October, A wrote an insulting comment on an article about Hanni, saying things like, "What the hell is she even saying? Is she f***ing crazy? Does crying help? Huh?"

The article in question was about Hanni appearing as a witness at the parliamentary audit for the National Assembly's Environment and Labor Committee, where she shed tears while discussing unfair treatment she experienced at her agency.

Following this, the prosecution sent A to a formal trial rather than a summary indictment. However, it was reported that A reached a settlement with Hanni's side before the verdict was announced.

Hello.

Yesterday and today, there have been a flood of speculative articles regarding Hanni's residency status in South Korea, and false information is spreading. We want to clarify the situation.

Hanni obtained a new visa yesterday (2/11) through proper procedures. 

Hanni and her parents were pressured by ADOR, using the 'visa' issue, which is a sensitive issue for foreigners living in South Korea. ADOR demanded Hanni to sign a visa extension consent form that lists ADOR as her agency. They even sent emails stating that if Hanni didn't agree, she could become an illegal resident. Additionally, ADOR submitted documents requiring personal information and her signature to the authorities without her consent and only notified her about it afterward, which is unacceptable.

Some media outlets have been carelessly using the term 'illegal resident' based on unconfirmed facts, spreading false rumors, and causing unnecessary public complaints. They also spread false information by stating the source of the information as 'Anonymous Official in the Music Industry' regarding the progress of Hanni's visa, which can only be confirmed with personal information. Although today's articles stated that 'ADOR could not confirm' the situation, the first reports claimed that 'ADOR prepared and applied all the documents for (Hanni's) visa extension, but she refused to sign.'

Around 70 articles have been published just yesterday and today, speculating on the type and expiration date of her visa, which is personal information and not meant to be publicly disclosed. We express deep regret that sensitive information, that only ADOR and the person in question know, has been recklessly spread through the media.

Using or disclosing personal information without consent is unacceptable. We believe that publishing such unverified information is also a serious issue. In the past, there were incidents where individual members' personal information was used to track their immigration records, and the situation is getting more severe. To protect the members, we are considering taking legal action.

Rep. Park Jiwon: 'NewJeans Hanni is at risk of becoming an illegal immigrant ... Legal Department should take action"

 

Rep. Park Jiwon of the Democratic Party talked about the expiration of NewJeans Hanni's visa during the National Assembly's Legislation and Judiciary Committee meeting.

During the plenary session held at the National Assembly on the 12th, questions were raised regarding the expiration of NewJeans Hanni's visa, who is now part of the group rebranded as NJZ.

Rep. Park Jiwoo asked the Minister of Justice, Kim Seokwoo, saying, "Do you know the famous idol group NewJeans? One of the members, Hanni, is at risk of becoming an illegal immigrant and getting kicked out of the country. What actions are being taken?"

In response, Kim Seokwoo replied, "I am aware of the issue. Our team is currently reviewing the matter, and I will look into it closely.”

Rep. Park said, "The people are already annoyed with the current export situation, so I hope the Ministry of Justice handles this matter well so that idols can continue their activities without any legal issues."

On the 11th, it was reported that Hanni refused to sign documents prepared by ADOR to extend her visa. ADOR's representative declined to comment on the matter, saying, "I can't confirm this."

Hanni, who holds dual citizenship in Australia and Vietnam, needs to obtain an E-6 (Arts and Entertainment) visa, which is issued under the condition of employment by her agency, in order to engage in entertainment activities in South Korea. Her visa reportedly expired in early February. Although she can stay in South Korea as a party involved in a lawsuit, she cannot engage in entertainment activities. It is speculated that NewJeans may be unable to perform as a full group in South Korea for the time being.

'Australian-Vietnamese' Hanni, faces dilemma as her stay in South Korea is illegal ... At a crossroads amid visa extension denial

NewJeans' member, Hanni, who has been claiming to have terminated her exclusive contract with ADOR, is now in a dilemma. If her claims are true, Hanni has been considered an illegal immigrant for the past week since the 14th.

According to TenAsia's investigation on the 20th, Hanni is facing a difficult situation due to visa issues. On November 28, Minji, Hanni, Danielle, Haerin, and Hyein unilaterally notified ADOR of their contract termination.

Currently, they are in a state of being without a management agency. Apart from restrictions and inconveniences in their activities, a legal issue has arisen: the visa problem for the foreign members. While Danielle, who holds dual citizenship in Korea and Australia, is not facing any issues, Hanni, who holds dual citizenship in Australia and Vietnam, is classified as a foreigner and must renew her visa annually. This is where the dilemma arises.

While Hanni claims that her contract with ADOR has ended, she is currently staying in Korea on a visa provided by ADOR. This basically means that ADOR is still her management agency and that her exclusive contract is valid. If her claim of contract termination is accepted, it means her exclusive contract ended on November 29 and as she would no longer have a management agency, the visa issued to her by ADOR would no longer be valid. According to the Immigration Control Act, Hanni should have returned her Alien Registration Card and left Korea by the 13th of this month, which is within 15 days of the date she claimed to have terminated her contract with ADOR.

Based on her claims, Hani is technically an undocumented resident as of now. While the Immigration Control Act allows for a change of workplace under an existing visa, this requires consent from the previous management company. However, since ADOR maintains that their exclusive contract with NewJeans is still valid, it is highly unlikely that ADOR would grant such consent.

70% of articles related to NewJeans have their comment sections open, and the age and gender ratio of commenters is abnormal

It's so bizarre that I listed all NewJeans Hanni-related articles that was posted on the 20th.

Out of over 100 articles, 70% had their comment sections open.

The Ministry of Labor responds to the workplace harassment case. They don't determine whether workplace harassment occurred or not. They just gave a dismissive statement that (Hanni) is not a worker.

At 08.50, Sports Chosun released an article stating that HYBE denied any workplace harassment. Following that, a bunch of articles saying that HYBE didn't engage in any workplace harassment were posted.

Most of the articles with open comment sections are flooded with malicious comments from men in their 30s, 40s, and 50s.

Since 2020, regulations have required comment sections on celebrity articles to remain closed, but after April, a disproportionate number of NewJeans articles have had their comment sections open, often posted under the "Lifestyle" section.

And the wording used in these articles is often slightly recycled.

Some malicious or false comments are deleted after some time.

Yesterday morning, articles flooded in with hateful comments, but when I checked again today, half of them were deletedㅋ Now that I look at it, this seems like a tactic. They post malicious comments in bulk under similar keywords at a set time and then delete them before the day ends? If this happens again, we neet to immediately collect evidence, compile it in a PDF file and report it! 

Meanwhile, only four articles so far have covered HYBE's toxic contract clauses that were revealed earlier today.

Ministry of Labor: "NewJeans' Hanni is not a worker" ... Workplace harassment case closed

Regarding allegations that NewJeans' member, Hanni, was "ostracized" within HYBE, the Ministry of Employment and Labor concluded, "She does not qualify as a worker under the Labor Standards Act," therefore workplace harassment regulations do not apply.

On the 20th, regarding the complaint filed by NewJeans' fans for allegations of workplace against NewJeans' member Hanni Pham the Seoul Western District Employment and Labor Office under the Ministry of Employment and Labor stated, "We have closed the administration because she does not fall under the category of a worker as defined by the Labor Standards Act."

The Western District Office, which investigated the complaint, explained, "Given the content and nature of Hanni's management contract, it is difficult to classify her as a worker under the Labor Standards Act, which requires labor to be provided under a subordination relationship in exchange for wages."

The reasons cited include, "The relationship is limited to fulfilling obligations as equal contracting parties, making it difficult to view it as employer-supervisor authority."

Additionally, "The company’s employment rules, regulations, or systems applied to general employees are not applicable to her," "She does not have fixed working hours or workplace, and she does not adhere to set commuting hours," and "Costs required for entertainment activities are jointly shared by the company and Hanni" were also presented as reasons.

Furthermore, it was noted that "The payments received are in the nature of profit-sharing rather than compensation for labor itself," "Taxes are paid individually, and business income tax is charged instead of earned income tax," and "She appears to bear the risks of generating profits and incurring losses through entertainment activities."

The Western District Office also referenced a Supreme Court ruling from September 2019, which categorized exclusive contracts with entertainers as civil mandate contracts or unnamed contracts similar to mandates under civil law, making it difficult to classify her as a worker under the Labor Standards Act.

However, after Hanni appeared as a reference witness at the National Assembly Environment and Labor Committee audit and testified, both ruling and opposition parties voiced the need for legal measures to address the absence of 'worker status' protection for artists, raising interest in potential supplementary legislative measures.

On the evening of October 8, the mothers of NewJeans members stated in an interview with Ilgan Sports: "Belift Lab made a statement on the 7th, but it contained too many incorrect facts. We all requested CEO Kim Jooyoung of ADOR to issue an official statement as ADOR’s representative on this issue. However, Kim Jooyoung replied that if they issue a statement based on the parents' and Hanni’s explanation of the situation, there is a high possibility that there will be further rebuttals. If this happens, it could lead to a vicious cycle of back-and-forth responses. For this reason, she decided not to issue a statement."

Mother A, one of the NewJeans members' mothers, said, "There are issues now and we want to correct the facts, we have no place to express our stance, and it’s supposed to be the agency’s role to do that. Since they refused to do it, we had no choice but to contact Ilgan Sports again."

Previously, in a NewJeans emergency live broadcast on September 11, Hanni revealed that while waiting in a hallway in HYBE's building, she greeted another artist. However, when she encountered that artist again, the manager beside her told the members, "Ignore her," which shocked viewers. In relation to this, the National Assembly's Environment and Labor Committee selected ADOR’s CEO and HYBE’s Chief Human Resources Officer, Kim Jooyoung, as a witness for a national audit on workplace bullying, and Hanni as a reference witness.

In an interview published by Ilgan Sports on the 7th, NewJeans' mothers claimed that although the CCTV footage of Hanni greeting the other artist exists, the footage containing the 'Ignore her' remark has been deleted. They criticized the current ADOR management and HYBE for not taking proper action to resolve the issue.

On the 7th, in response, HYBE released a statement under Belift Lab’s name on its official website, stating, "We strongly demand that groundless attempts to defame a rookie artist by making unfounded claims about greetings, following baseless plagiarism accusations, be stopped immediately. ILLIT's manager never made a remark to 'ignore' a NewJeans member. When we reviewed the footage together with CEO Min Heejin's side on August 14, her side raised a new argument that the greeting occurred after the footage shown."

Mother A responded, "Belift Lab’s claim in their statement that this is a ‘greeting issue, a matter of goodwill between labels,’ is distorting the core of the problem. Hanni never mentioned that they never greeted her. The issue is that the other artist's manager allegedly told them to ignore Hanni."

She continued, "We have made efforts to resolve this matter within the company. We never publicly pointed fingers at a specific label or artist. However, Belift Lab’s statement, which includes false claims, is tarnishing both NewJeans and our families’ reputations."

Mother B, another NewJeans member’s mother, added, "CEO Kim Jooyoung said she was surprised to know that we conducted an interview without consulting the company. In fact, we have repeatedly asked for this issue to be resolved, and nothing was done. That’s why we agreed to the interview. We also requested that CEO Kim issue a statement from ADOR regarding Belift Lab's falsehoods, but she refused because she's worried it might cause conflict between labels. If the company won’t fight against lies, where and how can we tell the truth?"

Mother B stressed, "CEO Kim said that she would issue an announcement to the entire HYBE team, including the artists, regarding greeting culture and manners so that this won't happen again in the future. I don't know how many times I've said it, but we are not raising an issue about 'greetings.' Our issue is about the unfair treatment NewJeans has received."

Mother B also revealed, "On June 13, we sent an official email to ADOR's board of directors raising the issue, but CEO Kim Jooyoung, who was also on the board, showed a lukewarm response. We requested photos of Belift Lab’s managers several times to identify those involved in this matter, but received no response."

She explained, "They claimed showing photos would raise human rights concerns. Then we asked if they can’t at least identify the manager responsible for the date and time Hanni mentioned? We never received a proper answer."

Mother B noted, "We checked how many times we have raised this issue. After reviewing the emails, we found that from June 13 to June 25, July 10, and July 20, we were in communication almost weekly through emails, continuously asking for help."

Mother C added, "We didn’t see any footage before the August 14 review. Therefore, Belift Lab’s claim that 'CEO Min Heejin’s side raised a new argument after seeing the footage' is a clear lie. Moreover, it wasn’t even CEO Min Heejin who made that claim, they’re just using her name to mislead the public."

She continued, "CCTV footage can only be checked by the individual, so Hani and a manager went to review it. How can Belift Lab claim that CEO Min Hee-jin’s side saw it and changed their stance? Their constant changing of stories and fabrication is frightening."

Mother C said, "At that time, Hanni was extremely busy preparing for the Tokyo Dome fan concert and other activities in Japan. That’s why she went to review the footage after wrapping up her Japan schedule."

"When we first raised the issue, we clearly explained that it happened when Hanni was alone. Yet on August 14, the footage that HYBE showed to Hanni was the one where she was together with an ADOR manager and Danielle."

Mother C added, "When Hanni came to check the footage, a security guard told her that there was other footage of them greeting when they came in and them passing each other without greeting when they exited. However, those were deleted because they didn't think it was necessary. The security guard was trembling and couldn’t even make an eye contact with Hanni while explaining this."

She stated, "Hanni explained this during a follow-up meeting with CEO Kim Jooyoung, who promised to recheck the facts since a new witness had come forward. However, Belift Lab’s statement focuses solely on the footage of the artist greeting at a 90-degree angle, completely ignoring the fact that the footage of them passing by without greeting was deleted."

Mother C concluded, "This is why we suspect that HYBE or Belift Lab might have intentionally deleted the CCTV footage to cover up the truth."

Another mother, Mother D, said, "They keep insisting that CCTV footage cannot be recovered after 30 days, but we never even asked for the footage. We didn’t even know the CCTV footage existed. When we found out they had it, we were relieved, but the fact that there’s no audio and no visible lip movements still makes us concerned."

Mother D added, "After two months, they finally showed us unrelated footage, claiming that the rest had been deleted due to the expiration of the storage period. This doesn’t seem like a genuine effort to address the issue, and even in CEO Kim Jooyoung’s email, communication has been unclear."

Mother D explained, "Belift Lab also claimed that the security firm handling the CCTV is an external company, which gives the impression that it’s outsourced. But the decision to review and delete the footage is clearly an internal issue within HYBE. This kind of misrepresentation, even in minor details, is not the right attitude."

ILLIT's agency, BELIFT Lab, has denied allegations that they instructed members to ignore NewJeans' Hanni's greeting.

On the afternoon of the 7th, BELIFT Lab released a statement on HYBE's official website, stating, "We strongly demand an immediate stop to the baseless allegations of plagiarism and the unfounded controversy regarding greetings, which are attempts to slander our rookie artist."

BELIFT Lab added, "The security company explained that it was impossible to secure additional footage because the 30-day video retention period had passed. Min's side is claiming that HYBE intentionally deleted the footage.

In connection with this case, the National Assembly's Environment and Labor Committee has summoned Kim Jooyoung, CEO of ADOR and HYBE’s Chief Human Resources Officer, as a witness for a hearing on workplace bullying. Hanni has also been selected as a reference witness.

BELIFT Lab pointed out, "Since the issue was first raised, we have always emphasized respectful behavior between artists from different labels, and we conducted the investigation with sincerity. However, even after providing all requested explanations, new unfounded claims continue to emerge. Now that this nonexistent incident is being brought up in the National Assembly hearing, we are beginning to suspect if there are other motives behind this."

They also warned, "If this matter continues to damage the reputation of our company, artists, or staff, we will take every means we can."

The decisive event that caused the NewJeans members to lose trust in HYBE was the 'greeting controversy' involving the manager of HYBE's girl group ILLIT. The incident dates back to around June, about three months ago. This was right after CEO Min won her legal battle against HYBE. ILLIT's company, BE:LIFT Lab, has denied that the group's manager ever told ILLIT to ignore NewJeans' Hanni.

On the 7th, BE:LIFT Lab stated, "The staff member (manager) that's in charge of ILLIT never told the members to 'ignore' NewJeans' members."

Last month on the 11th, NewJeans' Hanni claimed during a live broadcast that ILLIT's manager told the members to 'Ignore her', which sparked suspicions of bullying and workplace harassment. The National Assembly's Enviroment and Labor Committee selected NewJeans' Hanni and Kim Jooyoung as ADOR's CEO and also Chief Human Resources Officer (CHRO) of HYBE as witnesses for a parliamentary audit.

ILLIT's reps stated, "The staff member (manager) in charge of ILLIT never told the members to 'Ignore' NewJeans' members. Additionally, ILLIT's members never passed by NewJeans' members without greeting them." This was confirmed through the CCTV footage and investigation with staff and ILLIT's members after NewJeans' parents complained on June 13th.

BE:LIFT Lab explained that only time the two groups encountered each other was on May 27th, for about 5 minutes. The company said, "The CCTV footage captured ILLIT's members bowing 90 degrees to greet Hanni, who was standing in front of them as they got off from the elevator." The company added, "When we checked this CCTV footage with Min Heejon on August 14th, CEO Min's side argued that the incident (of ILLIT's members not greeting Hanni) happened after that encounter and claimed that there must be another video."

However, the security company explained that it was impossible to secure additional footage because the 30-day video retention period had passed. Min's side is claiming that HYBE intentionally deleted the footage.

ILLIT's side further stressed that it is highly unlikely for the manager to say 'Ignore her' as they use honorifics when addressing celebrities The company stated, "As they attempt to establish this untrue narrative as fact, the staff member (manager) in question is experiencing extreme frustration and going through hard times mentally. If this matter continues to damage the reputation of our company, artists, or staff, we will take every means we can."
