Looking closer into JBJ95's lawsuit ... "Breach of contract due to negligence" Lost 900M KRW in damages

According to the court, Kim Sang-gyun should pay 220M KRW and Takada Kenta 665M KRW to Star Road Ent. for damages that have been caused, the rest of the claims from Star Road Ent. are dismissed. Previously, Star Road Ent. filed a lawsuit against Kim Sang-gyun for 800M KRW and Takada Kenta for 1,7B KRW for damages. They claimed, "We don't accept their claim saying that we have failed to support their activities in the entertainment industry. The company's financial situation deteriorated in 2020 as an aftermath of COVID-19 pandemic. It's not because the company is not doing their job properly.

The court explained, "Some lessons like acting class were stopped due to the company's financial situations, but those were not lessons that are necessary." The court also added, "Kim Sang-gyun and Takada Kenta are the ones who breached the exclusive contract. Instead of breaking the contract one-sidedly, they should've used their talent and skill to continue activities in the entertainment industry". In addition, the court said, "We think they were already given a clear explanation and advance notice about the online concert"

On the issue of JBJ95's claim of unpaid wages and breach of an exclusive contract, the court explained, "After Star Road Ent.'s staff resigned, the CEO voluntarily replaced the place of JBJ95's manager and worked really hard to plan and organize for their online concerts. Therefore, JBJ95 is the one who is responsible for the breach of an exclusive contract"

-"Instead of breaking the contract one-sidedly, they should've used their talent and skill to engage in activities in the entertainment industry" --> I doubted my eyes for a second. Are they saying that JBJ95 is not putting any effort here?

-They should've performed in the middle of the lawsuit, though...ㅠㅠ

-They shouldn't have missed the concert just because they're filing a lawsuit. It's too bad, but there's nothing they can do right nowㅠ

-I wonder why did they decide to not attend their schedules...

-Did their lawyer not tell them that they shouldn't be skipping their concert?ㅠㅠ Even Chu doesn't miss her schedule in the midst of all. That's too bad.

-I think the damages were even bigger because they missed their concert...

-They were already notified about the online concert, but they refused to perform. That's why they caused even more damages for the company and therefore couldn't win the lawsuit.

-They should've performed even when they're filing the lawsuit, just like Chu. I wonder why they refused to perform. Did their lawyer not tell them about this?

-After reading the explanation from the court, I have to admit that they're the ones at fault here...

-Skipping concert only put them at bigger risk to lose the lawsuit, oh gosh...

"JBJ95 is responsible for breach of exclusive contract, not the company" ... Ruled to pay hundreds of millions KRW for damages

The court ruled that JBJ95 (Kim Sanggyun, Takada Kenta) was responsible for the breach of the contract between JBJ95 and Star Road Entertainment.

On October 21, The Civil Affairs Department of Seoul Western District Court held a lawsuit filed by 2 members of JBJ95 against Star Road Entertainment and a compensation lawsuit filed by Star Road Entertainment against JBJ95.

The court confirmed that the exclusive contract between JBJ95 and Star Road Entertainment is no longer valid, but they also added, "Kim Sanggyun should pay 220M KRW and Takada Kenta 665M KRW to Star Road Entertainment for damages"

Kim Sanggyun and Takada Kenta will bear 70% of the total litigation fees (sum of the main lawsuit and counterclaim), while Star Road Entertainment will bear the remaining 30%

-How are they going to pay that much money...

-Hul, they didn't get paid and had to use their own money as they attend their schedule. Do you really think they have that much money?

-Hul... That's a lot of money...

-Huk...???? What's going on.

-Oh Gosh... I guess this is why they still attend schedules in the middle of processing their lawsuit.

-They're just guys in their 20s who didn't get paid... How are they going to pay all of that?

-Does that even make sense??

-Kenta doesn't come from a wealthy family, though...

-Isn't that too cruel?? How is he going to get that 600M KRW from?

-I don't know what to say... I feel really bad for Kenta and Sanggyun.

-Does it make sense that Kenta has to pay them over 600M KRW? Is it even possible for someone to have that much money?

-Oh Gosh... I feel really bad for them.

-Why does Kenta have to pay more? Aren't they in the same group?
