A court has issued its first ruling recognizing a link between COVID-19 vaccination and death from myocardial infarction. So far, only a very small number of deaths reported have been recognized as having a causal relationship. The public is now watching closely to see if this ruling will have broader impact.

A, whose husband was a father of three and a 23-year career civil servant, says she still vividly remembers what he said.
A: He asked me, 'Is it okay to get the vaccine?' It was a situation where he had no choice but to get it.
Her husband, who was in a priority group for the vaccine, received a COVID-19 vaccine in June 2021 and passed away ten days later.
A: He was vomiting and collapsed in front of the bathroom. We kept performing CPR, but he couldn't recover and his heart stopped.
The cause of A's husband's death was acute myocardial infarction. The Korea Disease Control and Prevention Agency (KDCA) refused to pay compensation, stating that he likely died due to underlying conditions such as high cholesterol. His death was also not recognized as a death in the line of duty.
A: He got the vaccine because the country told him to, and he just worked after getting the shot... That's why we started a lawsuit against the KDCA.
After more than two years, the Seoul Administrative Court ruled in favor of A. This is the first time a causal link has been recognized for an acute myocardial infarction, moving beyond the four main side effects like myocarditis and pericarditis. The court judged that there was a close timing between the shot and the death, and it was difficult to conclude that he died from another cause. The court decided it is not medically impossible to conclude that the vaccine caused the death.
Lawyer Joo Sehyung: If it can't be clearly proven whether the heart attack is more likely to be caused by the high cholesterol or by the vaccine, then it is possible to acknowledge the link to the vaccine.
This ruling seems to reflect the purpose of the 'Special Act on Compensation for COVID-19 Vaccine Damage,' which was implemented in October last year. This law was created amid criticism that while the government encouraged the entire population to get vaccinated, it recognized causal links to subsequent illnesses too narrowly. However, the KDCA has appealed the decision, arguing there is still room for legal dispute as this is the first time causality for myocardial infarction has been acknowledged. Out of 2,643 reported deaths following COVID-19 vaccination, only 27 cases (about 1%) have been officially recognized as being caused by the vaccine.
